By engaging with Clearmind Health Ltd (“Clearmind”, “we”, “our”, or “us”), whether as a patient, potential patient, or interested party, you agree to be bound by these Terms and Conditions. This includes use of our website at www.thinkclear.co.uk, our software platforms, video consultations, secure messaging services, and any other digital or clinical services provided.

These terms must be read alongside our Privacy Policy, Refund Policy, and any other operational policies referenced herein.

2. Scope of Service

Clearmind Health provides private, remote medical services focused exclusively on ADHD assessment and treatment. We do not provide emergency care, and our service is not a replacement for your NHS GP or other health providers. We strongly recommend that you maintain registration with a GP for management of all non-ADHD conditions and for emergency support.

In the event of a crisis or serious mental health concern (e.g., suicidal thoughts, risk of harm to self or others), you must immediately contact your local NHS Crisis Team, dial 999 or visit your nearest A&E department for immediate assistance.

3. Confidentiality and Data Protection

Clearmind collects and processes personal and medical information to deliver care. Your information is stored securely, and we will not share your data unless:

  • You provide consent,
  • We are legally required to do so (e.g. serious risk to life or public safety),
  • It is necessary for your care (e.g. communication with your GP or pharmacy).

We will routinely ask your permission to share data with your GP.

All data is managed in accordance with the Data Protection Act 2018 and the UK GDPR.

4. Patient Responsibilities

As a patient or representative, you agree to:

  • Provide accurate, truthful, and up-to-date information about your health and history,
  • Notify us of any changes in your medical or mental health status,
  • Follow clinical guidance and medication instructions,
  • Inform us promptly of any side effects or adverse reactions,
  • Keep medications secure and away from others,
  • Not alter or tamper with any documents issued by Clearmind,
  • Attend scheduled appointments or cancel with appropriate notice.

Clearmind reserves the right to discontinue care if these responsibilities are not met, especially where safety may be compromised.

5. Identity Verification

All patients must complete identity verification prior or during to their first consultation. The patient will be asked to produce two of the following to confirm their identity, name and address and one of these must carry the patient’s photograph:

  • Passport
  • EEA/EU identity card
  • UK photo driving licence
  • EEA/EU full driving licence
  • Bank debit card
  • Credit or store card
  • Bank or building society statement/correspondence
  • Mortgage account statement/correspondence
  • Armed Forces ID card
  • Proof of age card containing unique reference number
  • Student loan account statement or correspondence

Under no circumstances will medication be prescribed until identity verification has been satisfactorily completed.

6. Clinical Assessments and Opinions

We value second opinions and respect professional differences. Clinical opinions may vary; the existence of differing opinions does not indicate an error or fault with the service. Treatment decisions are based on individual clinical judgment, professional standards, and safety.

7. Prescription Services

Clearmind Health issue private prescriptions only. These are typically dispensed by our partner pharmacy and delivered via a secure, cost-effective courier service. We do not issue NHS prescriptions.

8. Treatment Packages

Our assessment, treatment and follow-up are clearly described on this website. All packages exclude the cost of medication. Medication fees must be paid directly to the pharmacy.

Treatment will only begin once:

  • A confirmed diagnosis has been made
  • A mutually agreed care plan is in place
  • All fees due have been paid

Patients may discontinue treatment at any time, but doing so may carry risks, such as withdrawal symptoms or unresolved symptoms. You accept these risks if you choose to discontinue care.

9. Access and Platform Use

Clearmind provides access to a secure patient portal where screen to screen consultations take place. While we take all reasonable steps to maintain system uptime and data integrity:

  • We do not guarantee uninterrupted or error-free service.
  • Temporary outages may occur during maintenance or unforeseen incidents.
  • In case of technical failure, appointments may need rescheduling.

You are responsible for ensuring that you are able to access the internet in order to join all scheduled consultations.

10. Payment Terms

  1. General Payment Terms
    – All appointment bookings are subject to full upfront payment unless otherwise agreed.
    – Prices are clearly stated on the website. At your request these can also be e-mailed to you.
    – You are responsible for updating billing details and ensuring payment methods are valid.
  2. Cooling-Off Period
    Under UK law, you may cancel services purchased online within 14 days unless you choose to waive this right to receive earlier care. Booking an appointment within 14 days of purchase is considered a waiver of the cooling-off period.
  3. Missed Appointments & Refunds
    Missed or late-cancelled appointments are handled per our Refund Policy, available on our website.
  4. Non-Payment
    Failure to pay may result in:
    – Service suspension or cancellation,
    – Referral to collections,
    – Interest charged at 10% per annum above the Bank of England base rate,
    – Legal and administrative fees added to the outstanding balance.

11. Fees and Price Changes

Clearmind reserves the right to update its fee structure at any time Services may be withheld if payment is incomplete, invalid, or pre-authorisation fails.

12. Legal Framework

These Terms are governed by the laws of England and Wales. Disputes will be handled exclusively by courts within this jurisdiction.

13. Liability

Clearmind Health are not liable for:

  • Delays caused by external events beyond our control
  • Indirect or unforeseeable losses
  • Clinical outcomes that differ from expectations

Clinical documentation (e.g. letters, medical records) will incorporate the opinions of clinicians based on their clinical judgment and the information provided by you. We cannot guarantee these will match personal expectations or the professional opinion of other clinicians.

14. Severability and Enforcement

If any clause of these Terms is deemed unlawful, the remaining clauses remain valid. Delay in enforcing any part does not waive our right to enforce it later.

15. Data Subject Rights

Under data protection laws, you may request access to your personal data we hold. Requests can be made in writing to our Data Protection Officer.
